Con motivo de la publicación en el Diario Oficial de la
Federación el 26 de noviembre del 2012, del nuevo
Reglamento Interno de la Secretaría de Medio
Ambiente y Recursos Naturales (“SEMARNAT”),
sobre el particular, nos permitimos mencionar los
cambios más relevantes, a saber:
On November 26
2012, the new Internal
Regulations for the Ministry of the Environment
and Natural Resources (“SEMARNAT”) was
published in the Federal Official Journal, which
included several modifications, of which we allow
ourselves to mention the most relevant:
I.- Impacto Ambiental.
En materia de impacto ambiental, se le atribuye a las
Delegaciones Federales de la SEMARNAT, la
facultad de resolver las manifestaciones de impacto
ambiental (“MIAs”) modalidad particular; mientras
que quedan en la esfera de competencias de la
Dirección General de Impacto y Riesgo Ambiental,
las
MIAs
modalidad
regional;
y,
sólo
excepcionalmente, las MIAs modalidad particular,
cuando estas integren estudios de riesgo.
I.- Environmental Impact.
In environmental impact matters, the Federal
Delegations of the SEMARNAT were granted the
power to resolve the environmental impact
statements (“MIAs”), in the “particular” mode,
whereas the General Office of Environmental
Impact and Risk, was granted the power to
resolve the MIAs in the “regional” mode, and only
exceptionally, particular ones, when they include
risk studies.
II.- Acciones Colectivas
Por lo que respecta a las acciones colectivas, será la
Procuraduría Federal de Protección al Ambiente, la
autoridad facultada para iniciar la misma, por
violaciones a la normatividad ambiental.
II.- Class Actions
With regards to class actions, the Federal
Environmental Attorney will be in charge of
instituting the referred trial, in matters of violations
to regulations in the environmental sector.
III.- Cambio climático
En cuanto al rubro de cambio climático, se le otorgó
al Subsecretario de Planeación y Política Ambiental,
la facultad de fungir como autoridad nacional
designada para emitir las cartas de aprobación de
proyectos que se propongan y promover el desarrollo
del Mecanismo de Desarrollo Limpio.
III.- Climate change
In matters of climate change, the Sub-secretary of
Environmental Policy and Planning was granted
the power to act as the national authority in
charge of issuing letters of approval to projects
that are proposed in the promotion of the Clean
Development Mechanism.
IV.- Instituto Nacional de Ecología.
Por último, cabe mencionar que el anterior Instituto
Nacional de Ecología, pasó a ser un organismo
descentralizado, denominado Instituto Nacional de
Ecología y Cambio Climático.
IV.- National Institute of Ecology
Finally, mention can be made of the former
National Institute of Ecology, which now has the
nature of a decentralized organism, named the
National Institute of Ecology and Climate Change.
