DARWIN, THE LAW AND ECONOMICS
Sir David Attenborough’s series entitled “Frozen Planet” by the BBC included an
instalment entitled “Criminal Penguins” which contains footage of a penguin taking
pebbles from another penguin’s nest to build his own nest. These scenes took our
legal and commercial research in a new direction. Based on this, we put the following
questions forward:
1. In terms of economics and the game theory, is the accumulation of pebbles by
male penguins in the nest in order to be chosen by a female to reproduce
evidence of this theory in operation?
2. With reference to the law, is this being displayed by the two male penguins,
one collecting pebbles from the unoccupied parts of the beach and the other
near him, stealing his pebbles whilst he is collecting i.e. they know it is wrong
to steal hence one penguin acting covertly and the other on realising the
“theft” chasing after the perpetrator?
3. Does this behaviour exhibited by the male penguins prove the existence of
morals and ethics among penguins?
The questions above show us that even though we are talking about penguins, these
are issues that arise in the studies of philosophy and the law from a human point of
view. It therefore seems that Charles Darwin’s theory on the Evolution of the Species
was wider in its findings that simply evolution and also covered economics and the
law being subjects that arise out of the basic aim in all living things which is to
survive.

DARWIN, EL DERECHO Y LA ECONOMÍA
Las series de televisión de Sir David Attenborough "Frozen Planet" de la
BBC, incluyo un tramo titulado "Pingüinos Criminales", que contiene
imágenes de un pingüino “robando” piedras del nido de otro pingüino para
construir su propio nido. Estas escenas llevaron nuestra investigación legal y
comercial a un nuevo rumbo. En base a esto, quisiéramos presentar las
siguientes preguntas:
1. En términos de economía y la teoría de juego, ¿Es la acumulación de
piedras de pingüinos machos en el nido con el fin de ser elegido por una
hembra para reproducirse, evidencia de esta teoría en funcionamiento?
2. Con referencia a la ley, primeramente un pingüino recoge piedras de un
sector no ocupado de la playa, mientras un segundo pingüino que se
encuentra cercano, opta por “robar” las piedras del primero ¿Se muestra por
el actuar de los dos pingüinos machos, que saben que es “malo robar”, por lo
tanto, uno actúa “secretamente” y el otro tras realizar el “robo” persigue al
infractor?
3. Este comportamiento exhibido por los pingüinos machos, ¿Prueba la
existencia de la moral y la ética entre los pingüinos?
Las preguntas anteriores nos muestran que a pesar de que estamos
hablando de pingüinos, estos son los problemas que surgen en los estudios
de filosofía y de la ley desde el punto de vista humano. Por tanto al parecer,
la teoría de Charles Darwin sobre la evolución de las especies, fue más
amplia en sus conclusiones y traen consigo preguntas que involucran la
economía y la ley, temas que surgen sobre objetivo básico de todos los seres
vivos, que es el sobrevivir.
